In these conditions:
"The Company" means SAF. SAF is the trading name of Quayside Clothing Ltd, a company registered in England and Wales. Company no: 03048427.
"The Customer" means the person, form or company whose order is accepted by the company
"The Products" or "The Goods" means the products which the Company is to supply in accordance with these conditions of sale.
Terms & Conditions of Sale
The purchase of products from SAF is governed by these terms and conditions. By placing an order with SAF you agree to be bound by these terms and conditions.
Order acceptance
A purchase order can be confirmed by the Customer once sent in writing, either electronically via email, faxed or posted. Orders placed by the Customer will not be considered binding unless the order is accepted by the Company. Order acceptance from the Company may be in the form of e-mail, fax or post.
Artwork
Printing and/or embroidery will only be conducted upon confirmation from the client that the artwork has been approved. Artwork that has been approved in writing, either electronically via email, faxed or posted, is deemed to be the full and final responsibility of the client. All artwork and print charges will be levied where necessary.
Delivery
Delivery charges will vary by location and type and combination of products ordered. Delivery charges will be notified to you in your quote and confirmed upon acceptance of the purchase order. Products are dispatched by recorded delivery or courier.
Please note that delivery dates quoted are best estimate only and will not be legally binding.
Special rush deliveries may be arranged but will be subject to additional charges. You should make delivery destination and contact person clear at time of order.
Lead times
Lead-times will only start once we have received your artwork approval and cleared payment, we will acknowledge receipt of both.
Prices and Payment
The Company has the right to alter prices and garment specifications without proper notification.
Where applicable all prices quoted are subject to V.A.T at the current rate. In the case of non-account holders payment is due to the company immediately upon presentation on the invoice to the customer. SAF will not process the order until payment is received in full.
In the case of account holders if full payment of any invoice has not been received by the Company within 28 days of the date of the invoice then from the 29th day following the date of invoice interest will accrue to the Company upon the unpaid balance of the invoice at the Late Payment Interest Rate, defined as 8% above the Reference Rate by the Late Payment of Commercial Debts (Interest) Act 1998. If the company proceeds to recover the payment through the Courts or otherwise, the Customer will be responsible for the debt, interest administrative, legal and/or other costs incurred in the recovery of the debt.
Product Description
Every care has been taken to describe and portray products on this website and other marketing materials as accurately as possible, but variations in actual goods may apply. In particular colour representations may vary depending on your monitor, and while we endeavour to be as accurate as possible all sizes are approximate.
Stock
We cannot guarantee the permanent or continuous availability of all Products.
Goods offered are subject to actual availability at the time of order processing and the Company accepts no responsibility for any delay in supply whatever the reasons. We will not be liable for any losses or damages that arise from us being unable to supply the Products.
Samples
Samples are chargeable and sold as 'samples' not products, thus may contain personalisation or differ in colour from that ordered.
Cancellation Charges
A charge will be made on all cancelled orders, together with a charge for all the work carried out to the date of the written cancellation.
Refunds
Goods must be checked on delivery and only be signed for if received in good condition. If you find a purchase faulty please notify us within 24 hours and return it within 3 days. We will be happy to provide you with a replacement/refund (at our discretion), however please note that refunds are not available on customised orders unless the products are defective. If personalised goods are to be replaced the lead-time will be as per the order lead-time (subject to stock availability).
Passing of Title & Risk
The Risk in the goods shall pass to the Customer on delivery.
All goods, delivered or not, remain our property until payment is received by the Customer.
Input of Incorrect Information
The Company cannot accept any liability for any failure to comply with specific instructions stated on this web site or for any incorrect information provided by the Customer.
Your obligations as a Customer
You are responsible for:
- your own choice of product and its suitability for purpose
- artwork being of suitable quality for purpose (we will guide you as much as possible)
- making sure that we have received the artwork approval and final order
- we will send written confirmation once artwork and final order have been received.
- return of purchase orders and artwork approval forms by fax, e-mail or post, promptly in order that we can meet your deadline.
- making payment in good time in order that we can meet your deadline
You must provide the Company with all reasonable courtesy, information, cooperation to enable the Company to perform duties, failing which the Company shall not be obliged to perform any services or assistance.
